DEFINITIONS

The following definitions are used in this contract:
Customer: indicates a natural person who purchases the products for purposes unrelated to any entrepreneurial, commercial, artisanal or professional activity carried out;

ONLINE CONTRACT – General terms and conditions of sale

The ‘on-line ’contract, accepted on the website www.agricolestaniscia.it, is between Agricole Staniscia di Nicola Staniscia - C/da Nasuti 160/a – 66034 Lanciano (CH) VAT number: 02775570696, and a consumer, through an electronic sales system called e-commerce.

Consumer indicates, in relation to contracts for the sale of goods or the provision of services, the natural person who acts for purposes unrelated to any business or professional activity carried out. The term e-commerce refers to all those activities and exchanges of information that revolve around economic transactions between subjects and organizations, including public administrations.

Therefore, this contract must be concluded exclusively through the electronic channel called ‘Internet’, at the address www.agricolestaniscia.it

Below are the conditions of sale established by the supplier, which will remain effective until they are modified by the same. Any changes, corrections or updates will be reported in the appropriate section dedicated to the conditions of sale found on the website www.agricolestaniscia.it and will be effective from the time of their publication.

SUBJECT OF THE CONTRACT

The offer and sale of products on the agricolestaniscia.it website involve the establishment of a distance contract governed by Articles 50 and following of Legislative Decree no. 206 of 6 September 2005 (Consumer Code), and by Legislative Decree no. 70 of 9 April 2003 (so-called Electronic Commerce Act). The purchase of the products is intended only for private consumers.

ACCEPTANCE OF THE ORDER AND CONCLUSION OF THE SALES CONTRACT

By submitting a purchase order, the Customer declares to know and accept these conditions of sale and the additional information contained on the site. The contract will be considered concluded, and will be binding on both parties, only when the notice of shipment is sent to the Customer by e-mail to the address indicated at the time of purchase.

OBLIGATIONS OF THE BUYER

The Customer, by electronically confirming the order, declares to have read and fully accept the conditions of sale and payment indicated in the purchase process and in this contract and the section relating to privacy and security; he also undertakes to read, print and keep the conditions of sale set out below as provided for in articles 3 and 4 of Legislative Decree no. 185/1999.

It is expressly forbidden to enter false and/or invented personal data within the data collection forms necessary for the execution of the order, it is also expressly forbidden to enter data of third parties or make multiple registrations for a single consumer.

Agricole Staniscia di Nicola Staniscia reserves the right to prosecute such actions and any other fraudulent action against it and/or against other consumers.

SALES PRICES AND CONDITIONS OF PURCHASE

All sales prices of the products on the agricolestaniscia.it website are inclusive of VAT and any other tax, but not shipping costs, which are indicated separately. They constitute an offer to the public pursuant to art. 1336 of the Italian Civil Code. It is understood that the image provided in the product presentation may not perfectly represent its characteristics but may differ with regard to colour, size or the product accessories shown in the figure.

These prices may change at any time without Agricole Staniscia di Nicola Staniscia being required to give any notice; in any case, once the product has been ordered, it will not undergo any price change.

The shipment of all the items present and purchasable in the virtual store www.agricolestaniscia.it covers the entire national territory.

PAYMENT METHOD

At the time of purchase, the Customer may choose to pay by Credit Card, PayPal account or Bank Transfer. For payment by credit card or PayPal account, the Customer will be redirected to the PayPal payment platform, where they can make the payment in secure mode. The PayPal platform directly manages the data entered on its website to make the payment. Agricole Staniscia di Nicola Staniscia does not collect any data regarding the credit card used, or the PayPal access codes. This information is collected directly by the PayPal payment system. In the case of payment by bank transfer, the customer must make the payment within 3 working days of placing the order, following the instructions that are communicated to him on the website and in the automatic email with which the receipt of the order is communicated. The purchased goods will be sent to the customer only after the actual receipt of the transfer to the current account of Agricole Staniscia of Nicola Staniscia. The IBAN code at which to make the transfer may be code IT39H0306977751100000009330 of the Intesa Sanpaolo bank branch in Lanciano, made out to Agricole Staniscia di Nicola Staniscia. The reason for the transfer must indicate the order number, communicated in the aforementioned order receipt email (see example in the next section).

DELIVERY

Deliveries are made via SDA/Poste or BRT express courier in Italy, Europe and is intended to the point closest to the address specified by the Customer in the Order that can be reached by the Carrier. The transport includes the relative unloading but not porterage and transport to the floor.

Agricole Staniscia di Nicola Staniscia is in no way responsible for direct or indirect losses resulting from the fact that the carrier has delivered the products beyond the delivery date indicated in the general conditions nor responsible for other behaviors that do not comply with the general operating conditions of the carrier itself.

At the time of delivery, the customer must verify the integrity of the packaging and it is in any case strongly recommended to accept the package ONLY under reserve of inspection, affixing the words "Acceptance subject to control of damage" at the time of signature.

In the event of a discrepancy, the customer must reject the goods and dispute this discrepancy directly with the carrier and promptly send a written communication to Agricole Staniscia di Nicola Staniscia with related photos of the product.

The signature of the transport document without precise and motivated reservations implies acceptance of the goods on the part of the customer, without the possibility of recourse to the carrier.

In case of impossibility in the execution of an order due to unavailability of the material or other factors internal or external to the company, Agricole Staniscia di Nicola Staniscia undertakes to promptly inform the customer, agreeing on the possible return of the amounts paid.

DELIVERY COSTS

The costs for shipping all items present and purchasable in the virtual store www.agricolestaniscia.it vary depending on the total gross weight of the order and the destination, include VAT and packaging.

Shipping costs are calculated automatically after entering the destination address and before order confirmation.

In some cases and for some products, you will be offered the possibility of not incurring any costs for the shipment of the order. In these cases, notification of this possibility will be given directly on the website and in the order summary, before the purchase.

Acceptance of the package subject to control is always strongly recommended.

DELIVERY TIMES

Delivery times vary from 1 to 3 working days from the time of collection by the courier at our headquarters; the booking of the shipment of the goods will take place within 3 working days after payment is credited on the account of Agricole Staniscia di Nicola Staniscia in case of choice of payment by bank transfer; these terms are merely indicative and not binding. If the courier does not find anyone at the destination address, they will leave a note in the mailbox with the package code and the telephone number of their branch. Please call the courier to arrange the return of the package. The Customer must contact the courier as soon as possible to arrange delivery of the order. For problem-free delivery, the Customer should include a mobile phone number in the delivery details.

FEATURES OF THE ITEMS

Agricole Staniscia by Nicola Staniscia reserves the right to modify without notice the articles and the features of the goods on its site, in order to improve the quality of the offer according to the continuous technological evolution.The customer must take into account that honey and extra virgin olive oil are products that vary depending on the production seasons, the production period and the characteristics of the products themselves (for example, honey can crystallize based on the characteristics of the type chosen; extra virgin olive oil can thicken at low temperatures) and that the photos are only demonstrative of the products as the data relating to expiration dates and batches may vary from the photo.

The customer is responsible for choosing the items ordered.

Agricole Staniscia by Nicola Staniscia does not provide any guarantee about the suitability of the items for the specific use desired by the customer. Complaints against any defective or missing parts must be sent to the headquarters of Agricole Staniscia di Nicola Staniscia within 8 days of receipt of the items.

Agricole Staniscia by Nicola Staniscia is exempt from any liability for the use made of the products sold.

Agricole Staniscia by Nicola Staniscia is exempt from any liability for any direct and/or indirect damage caused by such use.

RIGHT OF WITHDRAWAL

Pursuant to and for the purposes of the Italian Consumer Code, as amended by Legislative Decree no. 21/2014, the Customer is given the right to exercise the right of withdrawal, without any penalty and without specifying the reason, within 14 calendar days from the date of delivery of the purchased item.

The right of withdrawal is exercised both with a written communication, to be sent to Agricole Staniscia by Nicola Staniscia, at the headquarters by registered mail with return receipt, and by email to info@agricolestaniscia.it.

The notice of withdrawal, both written and electronic, must indicate the Customer's data, i.e. Name, Surname and Address, Order number of the original order, telephone, product description, IBAN code and current account holder where you are asked to make the transfer for reimbursement (an example of an email is available at the end of this section).

As soon as this communication is sent to Agricole Staniscia, the Customer must send the product they wish to return, at their own expense and via a courier of their own choice, including in the shipment a letter with their data communicated by email (see form below).The returned product must reach Agricole Staniscia within a maximum of 14 calendar days from the date on which it communicated the withdrawal. Once the returned product is received by Agricole Staniscia, it will refund the price paid for the product/products for which the right of withdrawal was exercised, via bank transfer, within 14 calendar days from the day on which notification was given of the decision to withdraw, provided that the product has been received by the company, or unequivocal proof of shipment by courier has been provided.

The customer will be held responsible, and therefore not compensable, for the decrease in value of the goods resulting from handling other than that strictly necessary to establish the nature and characteristics of the goods. With regard to products for personal use and food items, the return of products already used is not permitted, for health and hygiene reasons. All risks concerning the transport of the returned product are borne by the Customer.

In the event of withdrawal, the customer will be required to pay the full cost for delivery; the difference due by the customer will be retained by Agricole Staniscia di Nicola Staniscia at the time of reimbursement of the price previously paid.

The consumer who will exercise the right of withdrawal will be required to return the items perfectly intact and unused, in all its parts.

To facilitate the Customer in exercising the right of withdrawal, here is an example of written communication and e-mail, to be included also in the envelope with which the returned product is shipped: Subject: communication returned order number: (indicate the original order number with which the good was purchased) Purchaser data: (indicate name, surname, address, telephone, e-mail) Product for which the right of withdrawal is exercised: (indicate the brand, name and product size, and product code as per the order summary sent in the original shipment) IBAN code: (indicate the IBAN number of the current account where you intend to receive the refund) Current Account Holder: (Indicate the holder of the current account where you intend to receive the refund).

CONTRACTUAL TERMINATION AND EXPRESS TERMINATION CLAUSE

Agricole Staniscia di Nicola Staniscia has the right to terminate the contract by giving simple notice to the customer; in this case the customer will be entitled exclusively to the return of the sum already paid, expressly renouncing to further requests for compensation of any kind.

The obligations assumed by the customer pursuant to art. 1 (Obligations of the buyer), as well as the guarantee of the successful completion of the payment that the customer makes with the methods referred to in art. 3 (Payment systems) are essential, so that by express agreement, the default by the customer of only one of said obligations will determine the legal termination of the contract pursuant to art. 1456 of the Italian Civil Code, without the need for a judicial ruling, without prejudice to the right for Agricole Staniscia di Staniscia Nicola to sue for compensation for further damage.

PROVISION AND PROCESSING OF PERSONAL DATA

The Customer's personal data is collected in order to complete the purchase contract and ship the orders received. These data are processed electronically in compliance with current laws and may only be exhibited at the request of the judicial authority or other legally authorised authorities. Personal data will be disclosed to persons delegated to carry out the activities necessary for the execution of the contract entered into and disseminated exclusively within the scope of this purpose, as expressly specified in Legislative Decree 196/2003.

The Customer's personal data is collected in order to complete the purchase contract and ship the orders received. Failure to comply with the aforementioned request authorizes Agricole Staniscia to immediately terminate the contract for non-fulfilment. The processing is carried out, also with the aid of electronic means, in compliance with the procedures that art. 11 of Legislative Decree no. 196 of 30 June 2003 guarantees the user and, in general, protects his rights, fundamental freedoms and dignity, with particular reference to confidentiality and personal66identity. The processing will take place for a period of time not exceeding that strictly necessary for the fulfilment of the purposes described above. Obtaining the deletion of your personal data is subject to sending a written communication sent to Agricole Staniscia by Nicola Staniscia.
